Like Daniel said, someone can be be deviant without being criminal. For instance, if an entire society only wore the color blue and one person started wearing red, they would be considered deviant by those around them, but it is not written into law that you can only wear blue so therefore, it is not criminal.
Additionally, many things that may have been criminal/deviant at one point can change as societies opinions change. Take marijuana for example (at least in the United States) at one point it was criminal nationwide. However, as time goes on, it has become less so in many states, but some can still potentially view it as deviant.
